1. Commission & Payment Matters
1.1. All currency references are in Singapore dollars (SGD). Tutors shall be responsible for payment of all levies, duties or taxes that are imposed by taxing rules for any payment or fees collected through using our home tuition services. For all tax enquiries, tutors should consult their own accountants.
1.2. Tuition rates listed on our website are guidelines. The exact price for the home tuition services may differ depending on our clients’ requirements, the market conditions, the availability of tutors, etc. The tutors can establish rates by themselves, but the final decision concerning price shall be accepted by the confirmed agreement of both parties – the client and the tutor – via an official confirmation invoice sent by FamilyTutor.
1.3. Clients shall make all payments according to the invoice(s) sent, and inform FamilyTutor within two days of the due date. It is the client’s responsibility to ensure that the bank transfer receipt is kept as proof of transaction made through cash deposit transfer, also frequently known as ATM transfer.
1.4. If the client or tutor has any outstanding amount owed to FamilyTutor, FamilyTutor will try its best to ask for payment via phone calls, SMS, WhatsApp or Telegram messages. However, after seven (7) days, if the payment is not made, physical payment reminder letters shall be sent by regular mail. FamilyTutor will not rule out the possibility of sending representatives to clients’ address to give face-to-face payment reminders. The account may also be referred to our lawyers for further recovery actions if settlement is still delayed despite payment letters sent. The account may still be referred to our lawyers if FamilyTutor deems the client as being reluctant in making the payment. The debtor shall be liable to pay all costs (including administrative, solicitor and client costs incurred by FamilyTutor in demanding and enforcing payment of money due on your above account(s). In cases of non-payment, FamilyTutor reserves the right to lodge a police report and/or even file a claim at the Small Claims Tribunals (under the State Courts) using the client’s information – including but not limited to the client’s name, mobile number, and residential address.
1.5. Any hourly tuition rate agreed upon between FamilyTutor and clients/tutors is final and should not be changed. FamilyTutor reserves the right to claim its commission based on the originally agreed tuition rate. Any invoice that FamilyTutor issues to clients and tutors is with effect from the date and time it is successfully sent by FamilyTutor (via WhatsApp, Telegram, and/or Email) unless the clients and tutors report any inaccuracy within the subsequent 12 hours.
1.6. In most cases, FamilyTutor will collect the conducted tuition fees directly from the client and will then subsequently resolve any payment issues owing to the tutor. Thus, for any cancelled tuition arrangement, clients are required to deal directly with the agency. If clients decide to pay the tutor directly and bypass the agency, clients shall be made liable to FamilyTutor for the commission amount if we fail to collect our agreed commission amount from the tutor, in addition to any administrative fees incurred by FamilyTutor in collecting the fees.
1.7. In general, tutors shall not collect the agency commission from the client directly. If they do so, they shall inform the FamilyTutor immediately. At notice by the agency, they shall make payment to the FamilyTutor in full within two (2) days. Tutors who fail to follow these instructions shall be liable to pay the full commission amount in addition to any administrative fees incurred by FamilyTutor in collecting the payment from the tutor. In cases of non-payment, FamilyTutor reserves the right to lodge a police report (for theft) and/or even file a claim at the Small Claims Tribunals (under the State Courts) using the tutor’s information – including but not limited to the tutor’s name, mobile number, and photo.
1.8. FamilyTutor reserves the right to change the commission amount due to non-fulfillment of tutor’s obligations or other reasons. Clients are liable to pay tuition fees for all lessons that are delivered, regardless of how satisfactory the lessons are. In cases of non-payment, FamilyTutor reserves the right to lodge a police report and/or even file a claim at the Small Claims Tribunals (under the State Courts) using the client’s information – including but not limited to the client’s name, mobile number, and residential address.
1.9. FamilyTutor reserves the right to change the commission amount in case there is any change in lesson duration and/or frequency requested by the client within the first 4 weeks of lessons. The commission amount will remain as 50% to 62.5% of the first 4 weeks’ worth of regular lessons.
1.10. Refunds may be made to the client’s bank account in case of violations of terms because of the tutor’s fault, or other reasons. On the other hand, clients can also be additionally charged for improper or unfulfilled payment obligations. FamilyTutor warns about this through SMS, WhatsApp, or Telegram messages.
1.11. If there are disputes or concerns regarding tuition fees between tutors and clients, FamilyTutor will provide assistance using reasonable means to help tutors to claim fees from clients and vice versa. However, FamilyTutor shall not be legally responsible for any payment disputes between the tutors and the clients. Clients shall inform both FamilyTutor and the tutor if a postponement or cancellation of any lesson is needed. If the tutor is only informed less than three (3) hours away from the start time of the lesson, clients shall be liable to pay for the lost time and transport cost to the tutor. The amount payable will be 50% of one (1) lesson’s worth of tuition fee. The client shall pay this amount in cash or via bank transfer/PayNow/PayLah immediately on or before the tutor’s next visit, or via bank transfer/PayNow/PayLah to the tutor within two (2) days after the cancellation or postponement if there is no more next visit. All cancellations or postponement of lessons shall not affect the commission amount collected by FamilyTutor.
1.12. All information included in the Frequently Asked Questions section on this webpage https://familytutor.sg/frequently-asked-questions/ and Tutor FAQ on this webpage https://familytutor.sg/tutor-faq/ are valid as part of the FamilyTutor’s Term and Conditions.
2. Cancellation, Replacement, and Postponement of Lessons
2.1. The client may request a replacement tutor or cancel at any time after the first lesson, but will still have to pay the attended tuition fees directly to FamilyTutor.
2.2. The tutoring period is usually stated clearly as we arrange the tuition assignment for the client. In the event that the tutoring period is not specified, all parties should be prepared to commit for at least three (3) months.
2.3. There is an unspoken agreement to complete at least one (1) lesson upon any tutor confirmation. If clients decide to cancel after one (1) or more lessons for any reason, only delivered lessons shall need to be paid for, and FamilyTutor will refund any of the remaining fees that are paid in advance. However, for cancellations even before the first lesson commences, the party (client or tutor) who does the cancelling will be legally liable for administrative fees no less than the equivalent of the first lesson fees which must be paid by the due date specified in the invoice.
2.4. The tuition schedule and the date and time of the first lesson shall be fixed and held to. Clients are allowed to re-negotiate the schedule with tutors directly. However, any changes in the frequency of lessons in the first 4 weeks of lessons must be made known to FamilyTutor. FamilyTutor may make fair adjustments to the commission amount under such conditions.
2.5. If the agreed tuition address is outside of the client’s home and if the tutor assigned cancels the lesson for whatever reason more than three (3) hours before the start of the lesson, the client will not be compensated for the time taken to travel from home to the tuition address. The tutor is then encouraged to make up for the missed lesson as soon as possible, or even provide a free make-up lesson while not affecting the commission amount collected by FamilyTutor. On the other hand, if the client fails to turn up for the lesson without informing the tutor at least three (3) hours before the start of the session, the client shall be liable to pay for the loss time and transport cost to the tutor.
